DCT Terms & Conditions of Business

 

 

  1. Definitions & Interpretations

 

In these conditions the following words have the following meanings:

 

‘Contract’ – The arrangement between the student and Devon Counselling Training under which the student will undertake the course subject to these conditions.

 

‘Course’ – The specific course the student has applied and been accepted for.

 

‘Student/They/His/Her’ – The person who accepts a place on the course.

'Organisation/they - The organisation who books DCT to run training courses.

 

‘Devon Counselling Training/DCT/We/Us/Our’ – Judith Blee trading as Devon Counselling Training.

 

‘Tuition Fees’ – The amount payable for the course services & tuition provided by Devon Counselling Training.

 

2. General

 

These conditions govern every contract for the provision of courses to Devon Counselling Training.

 

No variation of these conditions shall be binding unless agreed in writing by each party.

 

The headings in these conditions are for convenience only and shall not affect their interpretation.

 

We reserve the right to change or add to these conditions by written notice to the students.

3. The Courses

 

We offer a range of Continued Professional Development courses to counsellors, those in similar professions and outreach mental health training to organisations

4. Fees

 

Students and organisations will pay course tuition fees as stated in the course materials provided.

 

These will differ for each course.

 

Any additional expenses, which are not stated in the course materials and do not directly relate to tuition or related services provided by Devon Counselling Training, are the sole responsibility of the student and will not be covered within the course fees.

5. Terms of Payment

 

The student will be required to pay course fees in full at the time of enrolment or in instalments on the payment dates stated in the course materials and in agreement with Devon Counselling Training.

 

Receipts for payment will be issued

6. Refunds

 

All fees paid are non-refundable unless:

 

  • The student leaves within one week of starting a course, in which case a full refund will be given.

  • The student leaves within one month of starting a course in which case a 50% refund will be given.

  • If a course can not be run at the training centre due to government issued COVID19 guidelines we may deliver it over Zoom with no refunds. If a course still runs at the training centre but you can not attend due to government issued COVID19 guidelines we will give you a full refund or a place the next time we run it (whichever you prefer). If a course is cancelled you will be issued a full refund or a place the next time we run it (whichever you prefer).

  • Deposit payments are non-refundable unless the course is cancelled by Devon CounsellingTraining.

  • Deposit payments may be transferred to another course run by Devon Counselling Training.
     

 

  • If the student leaves at any other time during the course no refund will be paid.

  • In exceptional circumstances (e.g. ill health) Devon Counselling Training may come to an individual agreement with a student about refunds or transfer of funds to a different course.

7. Late or Non-payment of fees

 

If the student fails to pay course fees in full or is late with payment on the due date, Devon Counselling Training reserve the right, without exception, to suspend the student from the course, either permanently or until fees are paid up to date.

8. Duties & Obligations of the student

 

Devon Counselling Training shall require the student, for the benefit of themselves and all fellow students, to attend courses diligently and respectfully and to apply him/herself for the duration of the course.

 

The student will be required to notify Devon Counselling Training on any day of absence.

 

Repeated absence or lateness may result in the termination of the students contract, in which case, as stated in section 6, no refund will be given for course fees paid.

 

The student must maintain confidentiality throughout. This includes work with clients and personal work carried out in the group.

 

The student may be advised to undertake personal work including personal therapy during the course if we become concerned about the student's mental health.

 

9.Duration

 

The duration of each course will be set out in the course materials provided.

 

If the course is run in sections, Devon Counselling Training reserves the right to not allow continuation onto the next section if there are any concerns regarding the students suitability and/or behaviour on the course. Devon Counselling Training can terminate the students contract by written notice in this case.

 

10. Termination & Disciplinary procedure

 

A student may be called to a meeting if he/she is believed to be in breach of his/her obligations to any of Devon Counselling Trainings terms & conditions.

 

The meeting will consist of the student in question, an advocate for the student if requested, a senior representative form Devon Counselling Training and the course tutor/s. The student will be given the chance to put forward his/her case and if he/she is found to be in breach of his/her contract, Devon Counselling Training will issue a written warning to the student with an agreed date for appraisal for the issues to be resolved.

 

Only one written warning will be issued. If the requirements of the student are not met within the agreed timescale, Devon Counselling Training reserves the right to terminate his/her contract with immediate affect.

 

11. Important Exclusions

 

Devon Counselling Training shall not be liable for any personal injury or death howsoever caused whilst the student is attending Devon Counselling Training Courses, except where such injury is shown to be as a result of negligence or wilful default of Devon Counselling Training.

 

Any liability to any student in respect of the contract shall be limited to the amount of course fees paid by the student.

 

Devon Counselling Training shall accept no responsibility for any theft or damage to students’ possessions while on Devon Counselling Training premises.

 

12. Indemnity

 

The student shall indemnify Devon Counselling Training against all losses, damages, costs and expenses awarded against or incurred by Devon Counselling Training as a result of any negligence or reckless behaviour by the student including, without limitation, claims from fellow students resulting from any wrongful act of the student in question.

 

13. General

 

Any notice required to be given by either party to the other, under these conditions, shall be in writing addressed to the other party.

 

No waiver by Devon Counselling Training of any breach of these conditions shall be considered as a waiver of any subsequent breach of the same or any other conditions.

 

No Failure or delay on Devon Counselling Trainings part to exercise any of its rights will mean that we are waiving those rights.
